Acceptable Use Policy

Print / Save as PDF

1.0

This Acceptable Use Policy (“AUP”) specifies the actions prohibited to users of the network and systems (“infrastructure”) of Oxygn ISP (Pty) Ltd. Users are required to adhere to this policy without exception. The terms “User”, “Subscriber” and “Customer” are used interchangeably.

Aligned with Oxygn’s Terms and Conditions and Privacy Policy.

1. Introduction

1.1. Oxygn is committed to a secure, fair and open internet for all customers. By using our services, you agree to this Acceptable Use Policy (“AUP”) and are responsible for ensuring anyone using your connection does too.

1.2. This policy exists to protect our network and our customers, not to limit normal use. Every Oxygn plan is uncapped, and we do not throttle your connection for using it heavily. We manage or restrict traffic only to counter abuse, security threats or unlawful activity, as set out below.

1.3. We may update this policy by posting a new version on oxygn.co.za. Continued use of our services after an update means you accept the revised policy.

2. Scope

2.1. This AUP applies to all Oxygn services that provide or facilitate internet access, hosting, and related services (together, the “Services”).

3. What’s not allowed

These prohibitions are all about abuse, security and the law. They are what keep the network safe and fair for everyone.

3.1. Unlawful or harmful use

3.1.1. Any illegal activity, or any breach of local, national or international law.

3.1.2. Promoting violence or hate speech, or inciting criminal acts.

3.1.3. Fraud, defamation, or publishing offensive, obscene or discriminatory material.

3.1.4. Anything that compromises the stability or availability of our network or connected systems, including unauthorised access attempts or deliberate disruption.

3.2. Intellectual property

3.2.1. Using the Services to host, share or distribute material that infringes copyright, trademarks, patents, trade secrets or other rights without authorisation.

3.3. Spam and email abuse

3.3.1. Sending unsolicited bulk email, advertising (spam), chain letters or fraudulent messages.

3.3.2. Harvesting email addresses, or relaying email without permission.

3.4. Network interference

3.4.1. Deliberately disrupting our network or connected systems — for example DDoS attacks, or spreading viruses or malware.

3.4.2. Running unauthorised servers (web, email, file-sharing or gaming) without our consent, unless your package allows it.

3.5. Harmful or illegal content

3.5.1. Hosting, transmitting or promoting harmful, obscene or indecent material.

3.5.2. Any content involving child sexual abuse material or the exploitation of minors. We report this to the authorities without exception.

3.6. Security violations

3.6.1. Unauthorised access, monitoring or scanning of our or third-party systems — including hacking, phishing or distributing malicious software.

3.6.2. Impersonating others or stealing credentials for malicious purposes.

3.6.3. Using tools intended to breach network security or intercept data.

4. Network protection and product boundaries

4.1. Residential plans are for personal use. You may not resell the service, or use a personal plan to run a business, unless you are on a package that allows it. This is a product boundary, not a usage limit — a heavy household user is always welcome.

4.2. We may manage traffic on the network only to counter abuse, security threats or unlawful activity — for example to contain a DDoS attack, malware, or traffic that threatens the stability or security of the network for other customers. We do not prioritise, shape or limit normal customer traffic, and we do not slow heavy but legitimate use.

4.3. You agree not to use the Services in a way that is abusive, fraudulent or unlawful, or that deliberately degrades the network for others.

4.4. Business customers operate within their agreed package terms. Where a business package specifies particular terms, those apply in addition to this policy.

5. Your responsibilities

5.1. You are responsible for everything done over your connection and for ensuring anyone using it follows this policy.

5.2. If we let you know about a violation, please act promptly to stop it and prevent it happening again.

5.3. Please keep your devices securely configured so your connection can’t be misused by others.

6. How we enforce this policy

We always aim to resolve things reasonably. Depending on the severity, a breach of this AUP may lead to:

6.1. A warning or notice, giving you the chance to put things right.

6.2. Suspension or termination, for repeat or serious violations, which may be without advance notice where the breach is serious.

6.3. Recovery of costs or damages caused by the breach, including administrative costs.

6.4. Legal action, or cooperation with law enforcement, in serious cases involving illegal or harmful activity.

6.5. We may monitor traffic and content to ensure compliance with this policy, but we are under no obligation to actively monitor your use. Any monitoring is carried out in line with our Privacy Policy.

7. Reporting and support

7.1. To report a violation of this AUP, email hello@oxygn.co.za with as much detail as possible so we can investigate.

8. Dealing with our team

8.1. We ask that our team is treated with courtesy and respect when dealing with your query or enquiry.
